Introduction. By entering into this Cogeco US Finance, LLC d/b/a Breezeline (“Breezeline” or “Sponsor”) FREE INTERNET FOR 1 YEAR (“Giveaway”), each entrant (each an “Entrant”) agrees to abide by this Official Rules and Legal Disclaimer for Breezeline’s FREE INTERNET FOR 1 YEAR (the “Official Rules”) and the decisions of Breezeline, WHICH ARE FINAL AND BINDING IN ALL RESPECTS.
NO PURCHASE NECESSARY TO ENTER TO WIN. PURCHASE OF PRODUCTS OR SERVICES DOES NOT ENHANCE CHANGES OF WINNING.
WINNER MAY BE REQUIRED TO PARTICIPATE IN THE PRIZE FULFILLMENT PROCESS AND SIGN DOCUMENTATION, SUCH AS A RELEASE, PRIOR TO RECEIVING THE PRIZE.
Eligibility. This Giveaway is open only to legal residents of the United States who are eighteen (18) years of age or older at the time of entry who are residents of Maine, New Hampshire, Connecticut, Pennsylvania, Delaware, Maryland, Virginia, West Virginia, South Carolina, Ohio, and Florida. Corporate entities are not eligible and have no right to claim any Prize (defined herein) won by their employees. Employees, officers, directors, or agents of Sponsor, or any of Sponsor’s partners, related companies, agencies, or agents, as well as the immediate family (defined as spouse, parents, siblings, children, and grandparents), and same household members of any such employee, officer, director, or agent, are not eligible to participate.
Entry constitutes each Entrant’s certification that he/she meets the eligibility requirements set forth in these Official Rules.
Sponsor reserves the right to verify eligibility of any potential winner, it is sole discretion. All applicable federal, state, and local laws and regulations apply. Void where prohibited or restricted by law.
Free Internet For a Year promotion executed in partnership with WBNS FM (97.1 The Fan) to run Friday August 25, 2023 – September 8, 2023 at 3PM. Entries will be submitted digitally via 97.1thefan.com. Must be 18 to enter, no purchase necessary.
Limit one entry per person.
Entry. To enter this Giveaway, each Entrant, during the entry period, shall participate in FREE INTERNET FOR 1 YEAR at the physical or online location chosen by Sponsor and participate as instructed by Sponsor. Entrants may participate in FREE INTERNET FOR 1 YEAR once per day. The entry must fulfill all Giveaway requirements, as specified herein, to be eligible to win a Prize (defined below).
Entries that are not complete or do not adhere to these Official Rules or instructions of Sponsor may be disqualified at the sole discretion of Sponsor. Entries that are forged, altered, incomplete, incorrect (including false contact information), lost, late, misdirected, mutilated, illegitimate, or illegible will not be accepted and will be void and the Entrant disqualified from winning the Prize.
Odds/Selection of Potential Winners. Each participant shall be awarded a prize as a result of their participation (each, a “Prize”), according to the random result of their participation. Prizes may include but are not limited to: Complimentary internet service & equipment up to 200 mbps (12 months), a $500 VISA gift card (only for eligible non-serviceable customers), pens, koozies, sunglasses, and other physical objects.
Prizes. FREE INTERNET FOR 1 YEAR prizes may vary and are awarded as is. All Prize details not specified in these Official Rules will be determined in Sponsor’s sole discretion. Prizes will be given to the entrant at the physical location and time of
participation. Prize winners are solely responsible for all applicable: (1) federal, state, and local taxes; and (2) out-of-pocket expenses, associated with Prize acceptance and use. No transfers, Prize substitutions or cash redemptions will be made; however, Sponsor reserves the right to substitute alternate Prizes of comparable or equal value in its sole discretion. Sponsor will not replace any lost, mutilated or stolen Prize or any Prize that is undeliverable or does not reach the winner because of an incorrect or changed address or other contact information.
General Rules. By entering the Giveaway, each Entrant grants Sponsor the irrevocable, sublicensable, absolute right and permission to use, publish, post or display his or her name, photograph, likeness, voice, Prize information, biographical information, any quotes attributable to him or her and any other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Sponsor’s sole discretion) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind to him or her, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), throughout the world in perpetuity 3 Batterymarch Park Suite 200, Quincy, MA 02169 and without notice, review or approval, and each Entrant releases Sponsor from any and all liability related thereto. Nothing contained in these Official Rules obligates Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use.
All Entrants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right, in its sole discretion, to void entries of any Entrants who it believes have attempted to tamper with or impair the administration, security, or fairness of this Giveaway.
Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. If Sponsor determines at any time in its sole discretion that the winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere.
In the event there is an alleged or actual ambiguity, discrepancy or inconsistency between disclosures or other statements contained in any Giveaway-related materials and these Official Rules, the terms of these Official Rules will control. The invalidity
or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If the Giveaway is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel,
modify, or suspend the Giveaway and award the Prize from eligible entries received prior to cancellation, modification, or suspension, or as otherwise deemed fair and appropriate by Sponsor.
State Specific Rules: Citizens who win a Prize in Maryland and West Virginia shall have their prize delivered to them within 10 days of the winning announcement at no expense to the participant. Breezeline shall keep the name, address and description of
the prize of any winner in DE for two years. Must be 18 to enter, no purchase necessary. Limit one entry per person.
Release. BY ENTERING INTO THIS GIVEAWAY, EACH ENTRANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY SPONSOR AND SPONSOR’S By entering into this Giveaway, each Entrant agrees to release, hold harmless, and indemnify Sponsor and Sponsor’s employees, officers, directors, affiliates, partners, agents, and related companies (its “Affiliates”) from and against any claim, cause of action, demand, or proceeding (each, a “Claim”), and any resultant loss, injury (including death), cost, expense, fee, fine, penalty, or other loss or expense of any kind, including attorneys’ fees (each, a “Loss”), relating to or arising directly or
indirectly out of his or her participation in this Giveaway (or related activity such as a press release), and/or Sponsor’s right to exploit Entrant’s name and/or likeness or fully exploit any other right granted to it hereunder, and/or from Entrant’s receipt, use,
or misuse of any Prize, no matter how such Claim or Loss arises.
Limitations of Liability. IN NO EVENT SHALL SPONSOR OR IT AFFILIATES BE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS) ARISING OUT OF ANY ENTRANT’S PARTICIPATION IN THE GIVEAWAY, THESE OFFICIAL RULES, AND/OR ANY ENTRANT’S RECEIPT OF A PRIZE, NO MATTER UNDER WHAT THEORY ARISING, EVEN IF SPONSOR OR ITS AFFILIATE(S) HAD BEEN ADVISED OF THE POSSIBLY OF SUCH DAMAGES. SPONSOR AND ITS AFFILIATES ENTIRE LIABILITY WITH RESPECT TO ANY ENTRANT’S PARTICIPATION IN THE CONTEST, THESE OFFICIAL RULES, AND/OR ANY ENTRANT’S RECEIPT OF A PRIZE SHALL BE LIMITED TO FIVE HUNDRED DOLLARS ($500.00).
Additional Disclaimers. Sponsor is not responsible and/or liable for any of the following, whether caused by a Sponsor or an Affiliate, the Entrant or by other human error: entries that are submitted by illegitimate means or entries in excess of the stated limit; any lost, late, incomplete, illegible, mutilated, or misdirected entries, e-mail, mail, or other Giveaway-related correspondence or materials or postage-due mail; any error, omission, interruption, defect, or delay in transmission or communication; or errors, typos or misprints in these Official Rules, in any Giveaway-related advertisements or other materials.
Sponsor is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant’s e-mail account to receive e-mail messages. Sponsor is not responsible, and may disqualify an Entrant, if his or her e-mail address, telephone, or other contact information does not work or is changed without Entrant giving prior written notice to Sponsor.
Dispute Resolution. Entrant acknowledges and agrees that all Claims connected to or arising in any way hereunder shall be resolved solely on an individual basis. To that end, Entrant hereby waives the right to commence, to become a party to, or to remain a participant in, any group, representative class, collective, or hybrid class/collective action in any court, arbitration proceeding, or any other forum. Furthermore, the parties herein acknowledge and agree that (1) all Claims shall be heard exclusively by the state or federal courts situated in the Commonwealth of Massachusetts (2) that the laws of the Commonwealth of Massachusetts shall govern, without regard to its conflict of laws principles; and (3) that the parties hereto waive any right to a trial by jury.
